前天花了4900元购买了一台联想Kx4137电脑，把各种软件安装后，各种cat软件正常，但发现《金山词霸》2003的取词功能一开，IE、记事本就自动关闭，心想可能是VISTA系统的缘故。于是昨天又让电脑公司换成了XP系统，结果发现，不仅IE、记事本会关闭，而且鼠标指到任务栏和桌面时屏幕还不断地眨眼睛（各种图标消失后重新显示）。

2004年购买的2.4G处理器、512M内存电脑在XP系统安装什么软件都没问题，怎么现在四核处理器、2G内存的电脑XP系统竟然不认《金山词霸》2003，实在不明原因。

不愿意再折腾了，既让人家电脑公司麻烦，又耽误自己接稿。于是昨天晚上接了稿件。不过，现在电脑反应速度确实快了，过去trados翻译完一句向下一句过渡最少得等一秒以上时间，现在眨眼就打开下一句，根本不用等候。

 

《金山词霸》2003医学版可以说是迄今最完美，专业词典最多的电子词典，用起新电脑却无法正常使用这个词典，实在是一大遗憾。

SDL Trados Studio 2009将于6月份推出，这次版本将会彻底创新，采用RevleX™翻译记忆引擎、AutoSuggest™智能提示、Context Match、QuickPlace™ 等项实现“多、快、好、省”的翻译。

 

 

 

8、Except

       Article 16 A diplomatic agent shall be exempt from all dues and taxes, except:

       Article 17 Trust property shall not be enforced except under any of the following circumstances:

       Article 5 Except otherwise provided for in this Interpretation, the relevant provisions of the newly revised Trademark Law apply in the examination of cases of administrative proceedings instituted by interested parties out of dissatisfaction with reexamination decisions or adjudication made by TRAB after the entry into force of the Decision of the Amendment of the Trademark Law in respect of the circumstances under Articles 4, 5, 8, 9, paragraph one, 10, paragraph one (2), (3), and (4), 10, paragraph two, 11,12, 13, 15, 16, 24, 25 and 31 of the revised Trademark Law, which arose before the entry into force of the Decision of the Amendment of the Trademark Law;

       五、除本解释另行规定外，对商标法修改决定施行前发生，属于修改后商标法第四条、第五条、第八条、第九条第一款、第十条第一款第（二）、（三）、（四）项、第十条第二款、第十一条、第十二条、第十三条、第十五条、第十六条、第二十四条、第二十五条、第三十一条所列举的情形，商标评审委员会于商标法修改决定施行后作出复审决定或者裁定，当事人不服向人民法院起诉的行政案件，适用修改后商标法的相应规定进行审查；

       Article 22 Except the foreign-invested enterprises specified in the Maritime Transportation Regulations and Chapter IV of these Rules, the operators of the business relating to storage and warehousing of international shipments international, the operators of international maritime container freight station and container yard services shall, within 30 days of from the time of starting the above-mentioned services file the case with the competent communications department of the people''s government of the province, autonomous region or municipality directly under the Central Government where the enterprises are registered.

Except the provisions in items (3) and (4) of paragraph one of the present Article, the investors of the foreign-funded commercial enterprises to be established and the already established foreign-funded commercial enterprises that apply for opening stores shall submit respectively the application documents as prescribed in Article 12 and Article 13 to the competent commerce department at the level of the province where the foreign-funded commercial enterprise makes registration.

       　　（二）除本条第一款第（三）、（四）项另有规定外，拟设立外商投资商业企业的投资者、申请开设店铺的已设立的外商投资商业企业需向外商投资商业企业注册地的省级商务主管部门分别报送第十二条和第十三条所规定的申请文件。

       Article 34 Except otherwise stipulated by the Regulations and this set of detailed rules, companies issuing B shares shall abide by related regulations of related laws of the State as well as regulations of the Supervision Commission on disclosure of the companies' information.

       第三十四条 除《规定》和本实施细则另有规定外，发行境内上市外资股的公司应当遵守国家有关法律、法规和中国证监会发布的有关公司信息披露的规定。

       Article 9. Except where provided otherwise in these Measures, shares may be transferred but may not be returned.

       第九条股票除本办法另有规定外，可以转让，但不得退股。

       Article 17 Except as otherwise provided for in Article 20, where foreign investors establish a foreign investment enterprise through merger and acquisition of a domestic enterprise, the examination and approval authority shall, within 30 days upon its receipt of all the documents required to be submitted, decide according to law whether to approve the application for the establishment.

       第17条 外国投资者并购境内企业设立外商投资企业，除本规定第20条另有规定外，审批机关应自收到规定报送的全部文件之日起30日内，依法决定批准或不批准。

       2. Except for financial enterprises, there shall be no major amount held for trading financial assets or available for sale of financial assets, assets for lending to others, entrusted investment and other financial investments at the end of the latest accounting period; and

       (二)除金融类企业外，最近一期末不存在持有金额较大的交易性金融资产和可供出售的金融资产、借予他人款项、委托理财等财务性投资的情形；

       3. Except for financial enterprises, the current funds raised cannot be used as held for trading financial assets or available for sale of financial assets, for lending to others, for entrusted investment and other financial investments; they cannot be invested directly or indirectly in companies that are mainly engaged in the trading of securities;

       (三)除金融类企业外，本次募集资金使用项目不得为持有交易性金融资产和可供出售的金融资产、借予他人、委托理财等财务性投资，不得直接或间接投资于以买卖有价证券为主要业务的公司。

       Article 53 Except for the following circumstances, the fund manager shall pay redemption monies on a timely basis:

       第五十三条 基金管理人应当按时支付赎回款项，但是下列情形除外：

       Article 52 Except otherwise provided for by the fund contract, the fund manager shall handle the business of subscription and redemption of fund units on every working day.

       第五十二条 基金管理人应当在每个工作日办理基金份额的申购、赎回业务；基金合同另有约定的，按照其约定。

       Article 10 Except the payment of exchange against delivery, State Administration of Foreign Exchange (SAFE) should examine trade authenticity of all import payment of exchange by making selective examination of the customs declaration forms and other evidential documents provided by import entities for check.

       第十条除货到付汇外，外汇局通过审核、抽查进口单位向外汇局报审的海关进口货物报关单及其他凭证，核查所有进口付汇的贸易真实性。

       3. Except where the provisions of paragraph 1 of Article 9, paragraph 7 of Article 11, or paragraph 6 of Article 12, apply, interest, royalties and other disbursements paid by an enterprise of a Contracting State to a resident of the other Contracting State shall, for the purpose of determining the taxable profits of such enterprise, be deductible under the same conditions as if they had been paid to a resident of the first-mentioned State.

       三、除适用第九条第一款、第十一条第七款或第十二条第六款规定外，缔约国一方企业支付给缔约国另一方居民的利息、特许权使用费和其它款项，在确定该企业应纳税利润时，应与在同样情况下支付给该缔约国一方居民同样予以扣除。

       Article 8 Except for the purchase of tax-exempt agricultural products and import of goods, the input tax on purchasing of taxable items shall not be credited against the output tax in any one of the following circumstances:

       第八条　除购进免税农业产品和自营进口货物外，购进应税项目有下列情况之一者，不得抵扣进项税额:

       Article 3 Except for the circumstances specified in Article 4 of these Provisions, general taxpayer selling goods (including those regarded as selling goods), taxable services, or non-taxable services on which Value-Added Tax shall be levied as prescribed in the Detailed Rules for the Implementation of Value-Added Tax (hereinafter referred to as "selling taxable items") must issue special invoices to purchasers.

       第三条　除本规定第四条所列情形外，一般纳税人销售货物(包括视同销售货物在内）、应税劳务、根据增值税暂行条例实施细则规定应当征收增值税的非应税劳务（以下简称销售应税项目），必须向购买方开具专用发票。

       1) The examination and approval of the startup of foreign-invested projects can be divided into three phases, that is, examination and approval of project proposal, feasibility study report and corporate contract and articles of association. Except under three circumstances (projects that require the examination and approval by relevant departments of the State Council, projects containing capital construction or projects for which the State has separate regulations), the three phases can be merged into one, thus shortening the examination and approval period.

       (1)外商投资项目设立的审批分为项目建议书审批、可行性研究报告审批和公司合同、章程审批三个阶段，现除三种情况外（报国务院有关部门审批项目、有基本建设内容项目或国家另有规定的项目），可以将三阶段合并为一次审批，缩短审批周期。

       In practices, the examination and approval departments have greatly shortened the time of documents circulating through relevant government departments. Except the projects requiring the coordination and submission to the central government, the time of examination and approval for each project is within 10 working days.

       在实际工作中审批部门已经大大缩短了文件在政府机关内部的流转时间，现要求除了需要协调和报中央的项目，每个项目审批时间在10个工作日之内。

       Article 10 Except for the circumstances provided in Article 28 and Article 42 of the Patent Law, the application date mentioned in the Patent Law means the priority date if there is a right of priority concerned.

       第十条 除专利法第二十八条和第四十二条规定的情形外，专利法所称申请日，有优先权的，指优先权日。

       Article 11 Except where otherwise provided in this Law, the copyright in a work shall belong to its author.

       第十一条 著作权属于作者，本法另有规定的除外。

       Article 4 Except as stipuated in Article 13 of these Regulations, for taxpayers engaged in the sales of goods or the provision of taxable services (hereinfter referred to as "selling goods or taxable services" ), the tax payable shall be the balance of output tax for the period after deducting the input tax f or the period. The formula for computing the tax payable is as follows:

           第四条  除本条例第十三条规定外，纳税人销售货物或者提供应税劳务（以下简称销售货物或者应税劳务），应纳税额为当期销项税额抵扣当期进项税额后的余额。应纳税额计算公式：

       The power to dispose of the funds of the treasuries at various levels is vested in the financial departments of the governments at the corresponding levels. Except as otherwise provided by the laws or administrative rules and regulations, no departments, units or individuals shall, without the authorization of the financial departments of the governments at the corresponding levels, have the right to draw on any funds from the treasuries or dispose in any other forms of the funds already put in the treasuries.

       各级国库库款的支配权属于本级政府财政部门。除法律、行政法规另有规定外，未经本级政府财政部门同意，任何部门、单位和个人都无权动用国库库款或者以其他方式支配已入国库的库款。

       Article 10 Except in the preparation of traditional Chinese medicines into ready-to-use forms, pharmaceuticals must be produced in accordance with the national pharmaceutical standard and the technological procedures approved by the supervisory and administrative departments of pharmaceuticals under the State Council, and the record of production must be complete and accurate. The changes of technological procedure made by the pharmaceutical producing enterprises which affect the quality of the pharmaceuticals shall be examined and approved by the original approval authorities.

       第十条 除中药饮片的炮制外，药品必须按照国家药品标准和国务院药品监督管理部门批准的生产工艺进行生产，生产记录必须完整准确。药品生产企业改变影响药品质量的生产工艺的，必须报原批准部门审核批准。

       Article 17 Except for Articles 14 and 15 of the Law, no administrative license shall be set in any other regulatory document

       第十七条 除本法第十四条、第十五条规定的外，其他规范性文件一律不得设定行政许可。

       Article 36. Except as otherwise provided by the laws and regulations, in circumstances where, in accordance with the provisions of pertinent laws and regulations, a person concerned shall first apply to an administrative body for reconsideration and then bring a suit before a people's court if the person concerned does not accept the reconsideration decision, if the applicant does not accept the decision made by the administrative body for reconsideration to reject the application, the applicant may, within 15 days from the date of receiving the written decision on rejection of the application, bring a suit before the people's court.

       第三十六条 法律、法规规定应当先向行政机关申请复议，对复议不服再向人民法院提起诉讼的，申请人对复议机关不予受理的裁决不服，可以在收到不予受理裁决书之日起十五日内，向人民法院起诉。法律、法规另有规定的除外。

       Article 5. Except as otherwise stipulated by laws and administrative rules and regulations, the administrative reconsideration shall apply a single-level system of reconsideration.

       第五条 除法律、行政法规另有规定的外，行政复议实行一级复议制。

       Article 36 Except for the administrative penalties which may be imposed on the spot as provided in Article 33 of this Law, administrative organs, when discovering that citizens, legal persons or other organizations have committed acts for which administrative penalty should be imposed according to law, shall conduct investigation in a comprehensive, objective and fair manner and collect relevant evidence;

       第三十六条除本法第三十三条规定的可以当场作出的行政处罚外，行政机关发现公民、法人或者其他组织有依法应当给予行政处罚的行为的，必须全面、客观、公正地调查，收集有关证据；

       Article 3 The public security organs shall be responsible for investigation, detention, execution of arrests and preliminary inquiry in criminal cases. The People's Procuratorates shall be responsible for procuratorial work, authorizing approval of arrests, conducting investigation and initiating public prosecution of cases directly accepted by the procuratorial organs. The People's Courts shall be responsible for adjudication. Except as otherwise provided by law, no other organs, organizations or individuals shall have the authority to exercise such powers.

       第三条  对刑事案件的侦查、拘留、执行逮捕、预审，由公安机关负责。检察、批准逮捕、检察机关直接受理的案件的侦查、提起公诉，由人民检察院负责。审判由人民法院负责。除法律特别规定的以外，其他任何机关、团体和个人都无权行使这些权力。

       Article 40 Except where otherwise provided by this Law, a business operator that provides commodities or services shall, in any of the following circumstances, bear civil liability in accordance with the Product Quality Law of the People's Republic of China and other relevant laws and regulations:

       第四十条 经营者提供商品或者服务有下列情形之一的，除本法另有规定外，应当依照《中华人民共和国产品质量法》和其他有关法律、法规的规定，承担民事责任：

Article 21 In the petroleum contract the personnel needed for petroleum operations may be agreed upon, and the operators may give preference to Chinese citizens in respect of employment.

       The financial management system of unified accounting and fund disposition and hierarchical management in respect of its branch institutions shall be adopted.        金融企业应当对分支机构实行统一核算，统一调度资金，分级管理的财务管理制度。条件具备的，可以实行统一核算，统一调度资金，业务单元制管理的财务管理制度。

       Article 8 In case there exists any other special provision in respect of real right in any other law, such special provision shall prevail.

       第八条 其他相关法律对物权另有特别规定的，依照其规定。

       (1) basic information in respect of the franchiser and the franchisee;

       （一） 特许人、被特许人的基本情况；

       (3) documents in respect of quality management system of the orchard; and

       （三） 果园质量管理体系文件；

       Article 41 In the event of any legal or arbitral proceedings initiated prior to or during the domain name dispute resolution proceedings in respect of a domain name which is the subject of the complaint, the Provider or the Panel shall have the discretion to decide whether to suspend or terminate the proceedings, or to proceed to a decision.

       第四十一条 如果在程序正式开始之前或进行的过程中，当事人一方就被争议域名提起了司法程序或仲裁程序，域名争议解决机构或专家组有权决定中止或终止程序，或继续程序，直至作出裁决。

       (a) In the event of a dispute between an investor and a Contracting Party, the Contracting Party which is a party to the dispute shall not raise as an objection at any stage of the proceedings or enforcement of an award the fact that the investor which is the other party to the dispute has received, in pursuance of an insurance contract, an indemnity in respect of some or all of his or its losses, unless the investor has assigned his or its rights and claims to the First Contracting Party according to this Article.

       当投资者与缔约一方发生争议时，作为争议当事方的缔约一方不应在仲裁或裁决执行程序的任何阶段以作为争议当事另一方的投资者已根据保险合同而收到全部或部分损失赔偿的事实作为抗辩，除非该投资者根据本协定第十条已将其权利或请求权转让给了缔约一方。

       Article 18 In a suit of subrogation, the secondary obligor may, in respect of the obligee, avail itself of any defense it has against the original obligor.

       第十八条 在代位权诉讼中，次债务人对债务人的抗辩，可以向债权人主张。

       (3) the announcement in respect of the listing of the fund units;

       （三）基金份额上市交易公告书；

       5. The provisions of paragraphs 1, 2 and 3 shall not apply if the beneficial owner of the interest, being a resident of a Contracting State, carries on business in the other Contracting State in which the interest arises, through a permanent establishment situated therein, or performs in that other Contracting State independent personal services from a fixed base situated therein, and the debt-claim in respect of which the interest is paid is effectively connected with such permanent establishment or fixed base. In such case the provisions of Article 7 or Article 14, as the case may be, shall apply.

       五、 如果利息受益所有人是缔约国一方居民，在利息发生的缔约国另一方，通过设在该缔约国另一方的常设机构进行营业或者通过设在该缔约国另一方的固定基地从事独立个人劳务，据以支付该利息的债权与该常设机构或者固定基地或者固定基地有实际联系的，不适用第一款、第二款和第三款的规定。在这种情况下，应视具体情况适用第七条或第十四条的规定。

       Article 21 The term of protection of the right of publication, the right of exploitation and the right to remuneration in respect of a work of a citizen shall be the life time of the author and fifty years after his death, expiring on December 31 of the fiftieth year after his death. In the case of a work of joint authorship, such term shall expire on December 31 of the fiftieth year after the death of the last surviving author.

       第二十一条 公民的作品，其发表权、使用权和获得报酬权的保护期为作者终生及其死亡后五十年，截止于作者死亡后第五十年的１２月３１日；如果是合作作品，截止于最后死亡的作者死亡后的第五十年的１２月３１日。

       (3) any other relationship in respect of an association of reciprocal interests.

       (三)其他在利益上相关联的关系。

       Article 23 In the event that one of the following circumstances should arise in respect of a taxpayer, the tax authorities shall have the right to assess the amount of tax payable by the taxpayer:

       第二十三条纳税人有下列情形之一的，税务机关有权核定其应纳税额：

       Article 81 In addition to the provisions of this Chapter, the provisions of Chapter Ⅱof this Law regarding bills of exchange shall be applicable to endorsement, guaranty, payment and the exercise of the right of recourse in respect of promissory notes.

       第八十条 本票的背书、保证、付款行为和追索权的行使，除本章规定外，适用本法第二章有关汇票的规定。

       (11) other acts in respect of which penalties should be imposed.

       (十一)应当给予处罚的其他行为。

       (ii) In the case of difference between local decree and administrative rule in respect of the same matter, and applicable provision can not be decided, the State Council shall give its opinion, and where the State Council deems that the local decree should apply, then the local decree shall be applied in the local jurisdiction;

       (二)地方性法规与部门规章之间对同一事项的规定不一致，不能确定如何适用时，由国务院提出意见，国务院认为应当适用地方性法规的，应当决定在该地方适用地方性法规的规定；

       (ii) In the case of difference between administrative rules, or between local rules and administrative rules in respect of the same matter, and the applicable provision can not be decided, the State Council shall make a ruling;

       (三)部门规章之间、部门规章与地方政府规章之间对同一事项的规定不一致时，由国务院裁决。

       Article 9 In the event that no national law has been enacted in respect of a matter enumerated in Article 8 hereof, the National People's Congress and the Standing Committee thereof have the power to make a decision to enable the State Council to enact administrative regulations in respect of part of the matters concerned for the time being, except where the matter relates to crime and criminal sanctions, the deprivation of a citizen's political rights, compulsory measure and penalty restricting the personal freedom of a citizen, and the judicial system.

       第九条本法第八条规定的事项尚未制定法律的，全国人民代表大会及其常务委员会有权作出决定，授权国务院可以根据实际需要，对其中的部分事项先制定行政法规，但是有关犯罪和刑罚、对公民政治权利的剥夺和限制人身自由的强制措施和处罚、司法制度等事项除外。

       Clause 18 In a suit of subrogation, the secondary obligor may, in respect of the obligee, avail itself of any defense it has against the original obligor.

       第十八条在代位权诉讼中，次债务人对债务人的抗辩，可以向债权人主张。

       Article 7 In the event that any country or region applies discriminatory prohibition, restriction or other like measures against the People's Republic of China in respect of trade, the People's Republic of China may, as the case may be, take counter-measures against the country or region in question.

       第七条 任何国家或者地区在贸易方面对中华人民共和国采取歧视性的禁止、限制或者其他类似措施的，中华人民共和国可以根据实际情况对该国家或者该地区采取相应的措施。

       215.In this regard, the representative of China confirmed that China would progressively abolish the system of state trading in respect of silk by measures increasing and extending trading rights, with the result that China would remove completely the silk products set out in numbers 10 and 11 of Annex 2A2 to the Draft Protocol (list of products subject to state trading on exports) and grant the right to trade in such products to all individuals and enterprises no later than 1 January 2005.

       215．在这方面，中国代表确认，中国将通过增加和扩大贸易权的措施，逐步取消丝绸的国营贸易制度，最终中国将完全取消议定书(草案)附件2A2(国营贸易出口产品清单)所列第10项和第11项丝制品的国营贸易，并不迟于2005年1月1日给予所有个人和企业从事此类产品贸易的权利。

       99.3 Any dispute in respect of which:

       99.3 有关以下方面的任何争议：

       14.1 In the event of a Subcontractor having undertaken towards the Contractor in respect of the work executed; or the goods, materials, Plant or services supplied by such Subcontractor, any continuing obligation extending for a period exceeding that of the Defects Liability Period under the Contract, the Contractor shall at any time, after the expiration of such period, as sign to the Employer, at the Employer's request and cost, the benefit of such obligation for the unexpired duration thereof

       14.1 当分包商在所进行的工作，或其提供的货物、材料、工程设备或服务等 方面，为承包商承担了合同规定的缺陷责任期限结束后的任何延长期间须继续承 担的任何连续义务时，承包商在根据雇主的要求和由雇主承担费用的情况下，在 缺陷责任期满之后的任何时间，将上述未终止的此类义务的权益转让给雇主。

       Article 45 In the case of refusal to pay tax, which means the refusal to pay tax by using violence or menace, the tax authorities shall, in addition to pursuing the payment of the amount of tax a taxpayer has refused to pay, impose a punishment on the taxpayer in accordance with the provisions set forth in Paragraph 1 of Article 6 of the Supplementary Provisions Concerning the Imposition of Punishment in Respect of Offenses of Evasion of Tax and Refusal to Pay Tax.

       Article 39 In respect of minors reaching the age of fourteen who have committed crimes but are not subject to criminal punishment because they have not yet reached the age of sixteen, their parents or other guardians shall be ordered to subject them to discipline; when necessary, such minors may also be taken in for rehabilitation by the government.

       Article 96 To apply for increasing or modifying any kind of electronic banking business which is subject to examination and approval, an applicant shall submit the following application materials in duplicate to the CBRC and a copy to the institution dispatched by the CBRC at the place where the solely foreign-funded bank, equity joint bank or the branch of the foreign bank is situated:

       第九十六条申请增加或变更需要审批的电子银行业务种类，申请人应将下列申请资料一式两份提交银监会，一份提交独资银行、合资银行或外国银行分行所在地银监会派出机构：

       1.Being subject to a criminal punishment and an administrative punishment;

       （一）受到刑事处罚、行政处罚；

       The establishment of the Internet news information service providers prescribed in Items 1 and 2 of the preceding paragraph shall be subject to the examination and approval of the Information Office of the State Council according to the Decision of the State Council on Establishing Administrative License for the Administrative Examination and Approval Items Really Necessary To Be Retained and other relevant administrative regulations.

       根据《国务院对确需保留的行政审批项目设定行政许可的决定》和有关行政法规，设立前款第（一）项、第（二）项规定的互联网新闻信息服务单位，应当经国务院新闻办公室审批。

       Article 23 The customs should verify the license affixed with special seal for Textile License when handling related textile export formalities. To the exported textile subject to legal examination, the customs should handle the formalities of inspection and clearance by Clearance Sheet of Exit Cargo issued by inspection and quarantine organs.

       第二十三条海关在办理相关纺织品出口手续时，需验核加盖纺织品许可证专用章的许可证。对属法检出口的纺织品，海关还应凭检验检疫机构出具的《出境货物通关单》办理验放手续。

       (1)Basic conditions on the goods subject to the bidding;

       （一）招标货物基本情况；

       (1) Export commodities subject to inspection have been shipped out without inspection;

       一、应施检验的出口商品，未经检验已装运出口的；

       (3) the outcome of disposition of assets subject to liquidation.

       (三) 清算财产的处理结果。

       Article 24 The Measures are subject to the interpretation of the MOFTEC.

       第二十四条 本办法由外经贸部负责解释。

       Article 50 These Rules are subject to the interpretation of CNNIC.

       第五十条 本《程序规则》由中国互联网络信息中心负责解释。

       Article 47 Cases under the following circumstances are not subject to this regulation:

       第四十七条 以下情况不适用本办法：

       Article 29 To accept those items that are subject to uniform purchase, exclusive sale or monopolistic sale of the state, the pawnshop shall obtain the approval of the relevant departments of the government.

       第二十九条典当行收当国家统收、专营、专卖物品，须经有关部门批准。

       Article 36 To sell fund units for capital raising in accordance with this Law, a fund manager shall submit the following documents to the securities regulatory authority under the State Council and shall be subject to approval by the said authority:

       第三十六条 基金管理人依照本法发售基金份额，募集基金，应当向国务院证券监督管理机构提交下列文件，并经国务院证券监督管理机构核准：

       Article 26 To apply for fund custodian qualifications, the applicant shall meet the following requirements and shall be subject to examination and approval by the securities regulatory authority under the State Council and the banking regulatory authority under the State Council:

       第二十六条 申请取得基金托管资格，应当具备下列条件，并经国务院证券监督管理机构和国务院银行业监督管理机构核准：

       Article 42 To import or export products that are subject to license and quota control, a contractual JV shall go through the application formalities for license and quota in accordance with relevant State regulations.

       1. To fix prices that are subject to market regulation;

       （一）自主制定属于市场调节的价格； 

       The applicant may change the beneficiary subject to the consent of the insured.

       投保人变更受益人时须经被保险人同意。

       The designation of the beneficiary by the applicant is subject to the approval of the insured.

       投保人指定受益人时须经被保险人同意。

       b. To correct the acts violating the statutory provisions of law and discovered in the inspections or demand for correction within a prescribed time limit; to make decisions of administrative penalties according to the provisions of the present law and other relevant laws and regulations to those acts that shall be subject to administrative penalties according to law;

       （二）对检查中发现的安全生产违法行为，当场予以纠正或者要求限期改正；对依法应当给予行政处罚的行为，依照本法和其他有关法律、行政法规的规定作出行政处罚决定。

       Article 24 The following shall be subject to the approval of CISRC.

       第二十四条 代表处有下列情况之一的，应当报中国保监会批准。

       3. Never being subject to any criminal punishment, except some petty offenses.

       （三）未受过刑事处罚，但过失犯罪的除外。

       (3) those who are awaiting trials on bail or subject to residential surveillance;

       （三） 正在取保候审或者被监视居住的；

       Imported products shall not be subject to more than one conformity assessment.

       进口产品不得实行一种以上的合格评定程序。

       (1)  No bidding is carried out for projects which should be subject to bidding;

       （一）应招标的工程而未招标的；

       Article 7 To apply for importing the automobile products that are listed in the Catalogue of Goods Subject to Automatic Import License, which are administered by the Ministry of Commerce, the applicant's application materials must be verified by the local or departmental office in charge of import and export of machinery and electronic products.

       第七条申请进口列入《货物自动进口许可商品目录》中属商务部管理的汽车产品，申请材料须经地方、部门机电办核实。

       Article 8 To apply for importing the automobile products that are listed in the Catalogue of Goods Subject to Automatic Import License, which are administered by the local or departmental office in charge of import and export in charge of machinery and electronic products, the local or departmental office in charge of import and export of machinery and electronic products shall, after receipt of the complete application materials, issue the Automatic Import License immediately, or within 10 working days under a particular circumstance.

       第八条申请进口列入《货物自动进口许可目录》中属地方、部门机电办管理的汽车产品，地方、部门机电办在收到内容正确、形式完备的申请后，应当立即签发《自动进口许可证》；在特殊情况下，最长不超过10个工作日。

       6. Severe penalty being subjected to outside PRC customs territory; and

       （六） 在境外受到重大处罚；

       (2) having been subjected to criminal punishment, except for a crime of negligence; or

       (二)受过刑事处罚的，但过失犯罪的除外；

       (6) to be subjected to supervision according to law.

       （六）依法接受监督。

       (1) to have been subjected to criminal punishment for commission of a crime; or

       （一）曾因犯罪受过刑事处罚的；

 (i) the apprentice is subject to any obligations under any other contract of apprenticeship;

        (i) 有关学徒在任何其他学徒训练合约下负有义务；

        (b) subject to subsection (3), the apprentice (of the second part).

        (b) 学徒(立约另一方)，但第(3)款另有规定者除外。

        Any decision of the Registrar under sections 58 and 60 shall be subject to appeal to the Court.

        对于处长根据第58及60条作出的任何决定，均可在法院予以上诉。

        (5) The decision of the Registrar shall be subject to appeal to the Court.

        (5) 对于处长的决定可在法院予以上诉。

        (4) The yield on an asset, subject to subsection (5), shall be-

        (4) 在符合第(5)款的规定下，资产的收益率须为以下所述者─

        (i) that authority is subject to adequate secrecy provisions in that place; and

        (i) 该主管当局受该地方足够的保密条文所规限；及
